Start with the legal route, not the site visit
Foreign land ownership in Thailand is restricted, with specific legal exceptions and structures that may apply in defined circumstances. Thailand's BOI notes that promoted projects may request permission to own land subject to the relevant conditions and approvals.
The appropriate route is transaction-specific. Investors should obtain independent Thai legal and tax advice before relying on any ownership, lease, corporate or promoted-project structure. Nominee arrangements should never be treated as a shortcut.
A five-part preliminary screen
Before valuation, an investor should establish whether the opportunity can satisfy the intended use and delivery plan.
- Title and control: title type, registered owner, encumbrances, boundaries, access rights and transaction authority.
- Planning context: zoning, building controls, environmental constraints and consistency with the proposed use.
- Physical condition: topography, drainage, flood history, soil, contamination risk and demolition requirements.
- Infrastructure: road access, power, water, wastewater, telecoms and the timing and cost of any upgrades.
- Commercial logic: comparable evidence, total development cost, demand, phasing and credible exit routes.
Match diligence to the investment mandate
A resort site, logistics parcel, urban mixed-use plot and data center campus require different diligence priorities. The mandate should specify the intended use, minimum usable area, location constraints, infrastructure thresholds, investment range and decision timeline.
This allows unsuitable sites to be rejected quickly and focuses professional diligence on opportunities with a credible pathway to execution.
